1. About these terms
“We”, “us” and “our” mean Spoke & Sprocket. “You” means the person using this site or placing an order. If you are buying as a consumer, these terms do not limit your statutory rights.
2. Using this website
You may browse and use this site for lawful, personal purposes. You agree not to attempt to gain unauthorised access to it, interfere with its operation, or use automated systems to extract data from it in a way that places unreasonable load on our servers.
We aim to keep the site available at all times but cannot guarantee uninterrupted access. We may suspend, withdraw or change any part of it without notice.
3. Products and descriptions
We describe our products as accurately as we can, including materials, measurements and care instructions. Photographs are representative; colours can appear differently between screens, and small variations are normal in manufacturing.
Sizing guidance is intended to help you choose and is based on our own cut. It is not a claim about any external sizing standard.
All products are subject to availability. If an item becomes unavailable after you order, we will contact you and refund you in full.
4. Prices
Prices are shown in pounds sterling (GBP) and include any applicable taxes unless stated otherwise at checkout. Delivery costs are shown separately before you pay.
We take care to price accurately. If we discover an obvious pricing error in an order you have placed, we will contact you before dispatch and give you the choice of continuing at the correct price or cancelling for a full refund.
Where an item is shown as reduced, the higher price shown alongside it is the price at which we previously offered that item. We do not display inflated reference prices.
5. How a contract is formed
Your order is an offer to buy. Our confirmation email acknowledges we have received it, but it does not by itself form a contract. A contract comes into existence when we dispatch your order, and covers only the items in that dispatch confirmation.
We may decline an order, for example where an item is unavailable, where we cannot authorise payment, or where we reasonably suspect fraud. If we do, we will tell you and refund any payment taken.
6. Payment
Payment is taken at checkout through our payment providers. We accept the methods shown at checkout. You confirm that you are authorised to use the payment method you provide.
7. Delivery
Delivery is covered by our Shipping Policy, which forms part of these terms. Delivery estimates are estimates, not guarantees. Risk in the goods passes to you on delivery.
8. Returns and cancellation
Your cancellation and return rights are set out in our Return & Refund Policy, which forms part of these terms and does not affect your statutory rights.
9. Our liability
We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud, or under your statutory consumer rights.
Subject to that, we are not liable for losses that were not foreseeable at the time the contract was made, or for losses arising from your use of a product in a way it was not intended for.
Cycling carries inherent risk. Bikes are supplied partially assembled and we strongly recommend a safety check by a qualified mechanic before first use. Always follow the manufacturer instructions supplied with your bike, wear appropriate protective equipment, and make sure the bike is roadworthy before every ride.
10. Intellectual property
The content of this site, including text, product photography, graphics, layout and the Spoke & Sprocket name and marks, belongs to us or our licensors. You may not reproduce or reuse it commercially without our written permission.
11. Your account
If you create an account, keep your password confidential and tell us promptly if you believe someone else has used it. We may suspend an account we reasonably believe is being used fraudulently or in breach of these terms.
12. Privacy and cookies
How we handle your data is set out in our Privacy Policy and Cookie Policy.
13. Changes to these terms
We may update these terms. The version that applies to your order is the one published when you placed it.
14. Complaints
If something has gone wrong, email sales@spokesprockete.co.uk. We take complaints seriously and aim to acknowledge within one business day and resolve them promptly.
15. Governing law
These terms, and any dispute or claim arising out of them, are governed by the laws of England and Wales.
If you are a consumer, this does not take away any protection you have under the mandatory consumer law of the country where you live, and you may bring proceedings in the courts of that country. If you are buying as a business, the courts of England and Wales have exclusive jurisdiction.
